Answer two questions to see when your website and mobile apps must meet WCAG 2.1 Level AA under the Department of Justice's Title II rule, as amended in April 2026.
1. What type of public entity are you?

The two dates

The Department of Justice adopted its web and mobile app accessibility rule for state and local governments on April 24, 2024 (89 FR 31320). An interim final rule on April 20, 2026 (91 FR 20902) extended the compliance dates. Under 28 CFR 35.200(b) as amended:

  • April 26, 2027: public entities with a total population of 50,000 or more, other than special district governments.
  • April 26, 2028: public entities with a total population under 50,000, and every special district government.

Both dates apply to web content and mobile apps the entity provides or makes available, including through contracts, licenses or other arrangements. Read more in our post on the extension and the special districts guide.

What to do with the time

  1. Run an automated scan to find the repetitive problems (free homepage scan).
  2. Work through the WCAG 2.1 AA checklist on your most important pages and forms.
  3. Fix templates first: one fix to a header, menu or footer repairs every page.
  4. Put WCAG 2.1 AA in every new contract for web, document and app vendors.
  5. Publish an accessibility statement that tells people how to get help now.

Questions

Frequently asked

What are the ADA Title II website deadlines?

April 26, 2027 for public entities with a total population of 50,000 or more, and April 26, 2028 for public entities under 50,000 and for all special district governments. An interim final rule published April 20, 2026 (91 FR 20902) moved these dates back by one year from the 2024 rule.

How do school districts count population?

By the district population in the Census Bureau's Small Area Income and Poverty Estimates (SAIPE), not by student enrollment. Many districts with a few thousand students serve more than 50,000 residents.

Does a special district with a large population get the earlier date?

No. The rule gives every special district government the later date, April 26, 2028, whatever the population it serves.

Did the technical standard change with the new dates?

No. The standard is still WCAG 2.1 Level AA. Only the compliance dates moved.

Is this legal advice?

No. It applies the dates in 28 CFR 35.200(b) to the answers you give. Whether your organization is a public entity, a special district government or an instrumentality is a legal question for your counsel.
